Welcome to Yellow Bus. These Terms and Conditions ("Terms") govern your use of our school bus tracking platform, including this website, our school-admin dashboard, our Van Owner Portal, and our Driver and Parent mobile apps (together, "the Service").
By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Who these Terms apply to
The Service is used by schools (via their administrators), drivers, parents/guardians, and van owners contracted by schools. Some features and obligations differ depending on your role, as described elsewhere in the Service.
Description of the Service
The Service provides school bus tracking, including live vehicle location, trip status, child check-in/check-out records, announcements, and related administrative tools for schools. Live location depends on GPS signal, network connectivity, and device conditions, and may occasionally be delayed, inaccurate, or unavailable. The Service is a tool to support supervision of school transport — it does not replace a school's or driver's own duty of care, and should not be relied upon as the sole means of ensuring a child's safety.
Accounts
You must provide accurate information when registering, and keep your login credentials confidential. You are responsible for activity that occurs under your account. Schools are responsible for the accuracy of the driver, parent, and student records they create or approve on the Service.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, or in a way that could harm a child or another user
- Attempt to access accounts, data, or vehicles/routes that are not your own
- Interfere with, disrupt, or attempt to circumvent the security of the Service
- Reverse engineer, resell, or redistribute the Service without our written permission
Payments and subscriptions
Where fares, parent wallet top-ups, or school subscription plans are processed through the Service, payments are handled via our supported payment gateways. Fees, billing cycles, and refund terms are as displayed at the time of payment. You are responsible for keeping your payment details up to date.
Driver and van owner compliance
Drivers and van owners are responsible for holding all licences, permits, and compliance documentation required by Kenyan law to operate a school transport vehicle, and for keeping the documents they upload to the Service current and accurate. A school may suspend or reject a driver's or van owner's access based on outdated or non-compliant documentation.
Intellectual property
The Service, including its software, design, and branding, is owned by us or our licensors. You may use the Service only as permitted by these Terms, and may not copy, resell, or redistribute any part of it without our written permission.
Third-party services
The Service relies on third-party providers for functions such as SMS delivery, payment processing, and mapping. We are not responsible for outages or errors originating from these third-party providers, though we will make reasonable efforts to maintain reliable service.
Disclaimer and limitation of liability
The Service is provided "as is". To the maximum extent permitted by Kenyan law, we exclude liability for indirect or consequential loss arising from your use of the Service, and for delays, inaccuracies, or interruptions in location tracking caused by factors outside our reasonable control (including GPS/network conditions and third-party service outages). Nothing in these Terms limits any liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence.
Termination
We may suspend or terminate access to the Service for any account that violates these Terms, or at a school's request regarding its own users. You may stop using the Service at any time.
Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of Kenya, and any dispute arising from them will be subject to the exclusive jurisdiction of the courts of Kenya.
